Provider Terms and Conditions - NuAdventure
1. Introduction
1.1. NuAdventure prioritises common sense, transparency, and clarity in all interactions and transactions with our valued customers.
1.2. These general terms and conditions serve as the foundation of the contract governing our services related to travel, stays, and sports activities. It is imperative for customers to thoroughly review and understand these terms before engaging in any activities with NuAdventure.
1.3. Participation in NuAdventure's trips and activities is contingent upon strict adherence to these rules, as well as any supplementary guidelines provided in offers or related documentation.
2. Legal Framework and Jurisdiction
2.1. The sale of tourist packages by NuAdventure falls under Italian law, including Law No. 1084 of 27/12/1977, the Italian Tourism Code, and relevant international conventions. Any disputes shall be under the exclusive jurisdiction of the Court of Turin.
2.2. NuAdventure is committed to handling customer data in compliance with privacy regulations. We recognise and adhere to European Community travel regulations unless they conflict with local laws in the destination countries.
3. Booking and Enrolment
3.1. Booking procedures involve confirmation from NuAdventure, submission of signed contracts, and payment of deposits or balances. The reservation is considered confirmed upon receipt of these requirements.
3.2. Customers are required to provide all requested documentation within specified deadlines, including passports or insurance contracts, to facilitate a smooth booking process.
4. Currency, Quotas, and Prices
4.1. Prices are subject to fluctuations based on exchange rates and service costs. Offers are tentative and subject to confirmation based on availability. 4.2. Bookings are officially confirmed only upon receipt of the initial payment from the client.
5. Payments
5.1. Payments are to be made via bank transfer within specified deadlines. Failure to meet payment deadlines may result in contract modification or cancellation at NuAdventure's discretion.
5.2. Customers are responsible for ensuring timely payments and covering any associated bank charges.
5.3. NuAdventure reserves the right to cancel services if payments are incomplete by specified deadlines, with any amounts already paid by the customer forfeited.
6. Withdrawal and Refunds
6.1. Participants may request substitutions under certain conditions, subject to NuAdventure's approval.
6.2. Withdrawal before the service start date is possible, with penalties applicable based on the cancellation timeline.
6.3. Services subject to penalties by third-party providers are excluded from refunds. A cancellation fee of 30% is charged if canceled 45 days or more before the trip, while a cancellation fee of 100% is charged if canceled 44 days or less before the trip.
6.4. NuAdventure retains sole discretion and authority to alter itineraries as necessary or desirable.
7. Cancellation by NuAdventure
7.1. NuAdventure reserves the right to cancel trips due to events beyond its control, with obligations to refund participants.
7.2. Participants will be promptly notified of cancellations and offered alternatives if applicable.
7.3. Group trip cancellations due to insufficient participants result in full refunds or adjusted participation fees.
8. Responsibility
8.1. NuAdventure ensures accurate planning and execution of services, offering 24-hour assistance during trips.
8.2. Accommodation categories adhere to local regulations, with the organisation's discretion in selection.
8.3. Force majeure events may impact services, with no reimbursement possible. 8.4. Participants are responsible for their fitness and compliance with safety regulations during activities.
8.5. Participants agree to abide by all rules and regulations of NuAdventure and its carriers/operators. Failure to comply constitutes a material breach of this agreement.
9. Insurance
9.1. Travel insurance is strongly recommended for medical, cancellation, and activity-related coverage.
9.2. Participants are responsible for verifying insurance coverage and providing policy copies to NuAdventure.
10. Modifications
10.1. Modifications are subject to NuAdventure's discretion, with possible adjustments in costs.
10.2. Special requests must be made at the time of booking, with additional charges applicable.
10.3. Expenses due to errors in proposals or changes after confirmation may not be attributed to the customer.
11. Problems, Claims, and Complaints
11.1. Minor inconveniences should be addressed directly with service providers before contacting NuAdventure.
11.2. Deficiencies in services must be reported promptly to enable timely resolution.
11.3. Complaints must be submitted to NuAdventure within specified timelines.
12. Authority
12.1. Requests for changes must be directed to NuAdventure, with staff not authorised to accept changes.
12.2. Use of customer-produced material by NuAdventure for promotional purposes is agreed upon unless stated otherwise.
12.3. Additional clauses or changes require written confirmation from NuAdventure.
13. Waiver of Warranties
13.1. By signing this agreement, participants waive any and all warranties, whether express or implied, regarding the Adventure purchased through NuAdventure.
14. Policy of Personal Property and Valuables
14.1. NuAdventure is not responsible for theft, loss, or damage of personal property during the Adventure.
15. Notification of Personal Risk
15.1. Participation in NuAdventure activities involves inherent risks, and participants assume all responsibility for potential injuries or harm.
16. Waiver
16.1. Participants affirm their physical and mental fitness to participate in NuAdventure activities and waive all claims against NuAdventure for injuries, illnesses, or damages.
16.2. Participants indemnify and hold NuAdventure harmless from any suits, claims, or expenses arising from their actions.
16.3. Both parties agree to waive the right to punitive or exemplary damages in any legal proceedings related to this agreement or the Adventure. 16.4. This agreement is governed by Italian law, with disputes resolved in the State or Federal Courts of Sardinia, Italy.
17. Entire Agreement
17.1. This agreement constitutes the entire understanding between the parties, superseding any previous agreements or understandings.
18. Waiver of Jury Trial
18.1. Participants waive the right to a jury trial related to any claim arising from this agreement or participation in the Adventure.
